In addition to the default mentioned above, you were also notified <br />on June 20, 1995, that you had failed to= -supply us with a current <br />Insurance Certificate as required by Section 3.1 of our <br />subcontract. A current insurance certificate, with the required <br />coverages, naming Harris Sanitation, Inc. as an additional insured <br />and with a 90 day cancellation notification to the additional <br />insured, must be received by us within fifteen days or termination <br />of your subcontract will result, as provided by Section 2.2, <br />Termination of the subcontract. <br />Please contact me as soon as possible to arrange delivery of the <br />items required above. As in the past, let me know if I can be of <br />assistance to you in rectifying the default, but please note the <br />serious nature of this item. Based on the fact that you have been <br />previously notified, you must understand that the defaults must be <br />rectified within fifteen days. Please govern yourself accordingly. <br />Sinc re <br />Peter Jurg I <br />Division President & General Manager <br />Mr. Jurgel noted that the certificate of insurance states that <br />Mr. Reason's insurance was terminated on May 5, 1995. Mr. Reasons <br />was without insurance for 4 months before getting insurance on <br />September 5, 1995. <br />Mr. Jurgel advised that Harris sent Mr. Reasons certified <br />letters on several dates notifying him that he was in default. <br />Holding up green certified mail receipts, he noted that one letter <br />was returned unopened. Mr. Jurgel also advised that he had helped <br />Mr. Reasons by helping him locate a truck and advising him of the <br />things wrong with the truck. However, he emphasized that Mr. <br />Reasons just doesn't follow the rules and his going four months <br />without insurance is just too dangerous a liability for Harris. <br />Attorney Ron Casin, Ft. Pierce, speaking on behalf of Reasons <br />Sanitation, stated he was here in response to a letter sent by <br />Attorney Vitunac prohibiting Reasons from collecting waste within <br />Indian River County. Mr. Casin felt the problem is that the <br />parties are not communicating with each other. Mr. Jurgel has <br />indicated that several letters were sent but not received, but if <br />you don't receive a letter, you can't read it. Most people would <br />pick up a phone if they did not receive any response to a letter. <br />In this case, Mr. Reasons was not given the opportunity to fix the <br />problem. Mr. Reasons had a problem with his insurance, which was <br />cancelled, and rather than putting uninsured vehicles on the road, <br />Mr. Reasons parked his vehicles and leased vehicles from another <br />carrier that were insured.
