Board of County Commissioners Meeting Minutes - Final April 5, 2022 <br />The Chairman called for a recess at 10:55 a.m., and reconvened the meeting at <br />11:05 a.m., with all members present. <br />9. PUBLIC HEARINGS <br />NOTICE OF PUBLIC HEARING IS ON FILE IN THE OFFICE OF THE <br />CLERK TO THE BOARD. <br />10.A.1. 22-0244 ADOPTION HEARING: County Initiated Request to Amend the Text of the <br />County's Comprehensive Plan to add a new Chapter 13 Property Rights <br />Element. (Legislative) <br />Recommended Action: Based on the above analysis, staff and the Planning and Zoning Commission <br />recommend that the Board of County Commissioners approve the proposed <br />Comprehensive Plan Amendment. <br />Attachments: Staff Report <br />Proposed Chapter 13 Property Rights Element <br />Draft Property Rights Element Ordinance <br />Chief of Long Range Planning John Stoll referred to a PowerPoint presentation <br />which explained the Comprehensive Plan text amendment process. Chief Stoll <br />stated this was the second required public hearing, following the transmittal <br />public hearing on January 18, 2022, where the amendment was approved for <br />transmittal to State agencies for review. He added that no comments were <br />received from any of the reviewing agencies, and recommended the Board <br />adopt the proposed Ordinance. <br />Chairman O'Bryan received confirmation from Chief Stoll that this text <br />amendment was required by the State, and that the Ordinance used the State <br />model language. <br />The Chairman opened the public hearing. There being no speakers, the <br />Chairman closed the public hearing. <br />A motion was made by Vice Chairman Earman, seconded by Commissioner <br />Flescher, to adopt Ordinance 2022-004, amending the County's Comprehensive <br />Plan by creating a Property Rights Element in order to meet updated statutory <br />Indian River County Florida Page 9 <br />
