On motion of Commissioner Massey , seconded by <br />® Commissioner Loy the following resolution was <br />adopted: <br />RESOLUTION 70 -22 <br />40 <br />WHEREAS at the regular meeting of the Board of County <br />Commissioners of Indian River County, Florida held on June 5, <br />1968 Resolution Number 68-34 was adopted in which it was re- <br />solved that said County was to take the necessary steps to <br />acquire by donation, purchase or condemnation the necessary <br />rights of way for Section 88060, State Road 60, from a point <br />in the East -� of Section 30 Township 33 South, Range 38 East <br />easterly to the F.E.C. Railway in Vero Beach and to prepare <br />in the name of said county by its' County Commissioners all <br />condemnation papers. affidavits and pleadings and to prosecute <br />all condemnation proceedings to judgment and <br />WHEREAS at the regular meeting of the Board of County <br />Commissioners of Indian River County, Florida, held on <br />October 22, 1969, the motion was made, seconded and carried <br />that the firm of Smith, Heath, Smith and O'Haire be retained, <br />at a cost of $35.00 per hour, to complete the pending con- <br />demnation suits and <br />WHEREAS a bill for such services rendered, dated June 2, <br />1970 in the amount of $1,121.61 having now been received <br />from said firm of Smith, Heath, Smith and O'Haire, now there- <br />fore, be it <br />RESOLVED that said bill is hereby approved for payment <br />and be it further <br />RESOLVED that the State Department of Transportation is <br />hereby authorized to pay said bill to the firm of Smith, <br />Heath, Smith and O'Haire, either from proceeds of Florida <br />Development Commission Bonds issued for the purpose of con- <br />structing said project or from Secondary Gasoline Tax Funds <br />(Section 16, Article IX of Florida Constitution, Chapter 26321, <br />Laws of Florida, Extraordinary Session, 1949) <br />STATE OF FLORIDA <br />COUNTY OF INDIAN RIVER <br />I HEREBY CERTIFY that the foregoing is a true and correct <br />copy of resolution passed by the Board of County Commissioners <br />of Indian River County, Florida, at a meeting held the 10th <br />day of June, A.D. 1970 and recorded in the Commissioners' <br />minutes. <br />IN WITNESS WHEREOF, I hereto set my hand and official seal <br />this 10th day of June, A.D. 1970. <br />CLER C OF E BOARD OF <br />COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA <br />(SEAL4:` <br />CLER C OF E BOARD OF <br />COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA <br />
