4b <br />40 <br />RESOLUTION NO. 70-38 <br />WHEREAS, the Florida First National Bank at Vero Beach, <br />4&jm Executor of the Estate of Wellington G. Bosworth, made application to <br />the Board of County Commissioners of Indian River County to change <br />certain bulkhead lines heretofore established by the Board of County <br />Commissioners of Indian River County, and <br />WHEREAS, notice of the public hearing was published according to <br />law, and <br />WHEREAS, notice of the public hearing was given to the riparian <br />owners in accordance with the law, and <br />WHEREAS, a public hearing on said proposed change was held at <br />10:00 a. m. on September 9, 1970, and <br />WHEREAS, the Board of County Commissioners received evidence <br />that many years ago, Mr. Wellington G. Bosworth constructed a concrete <br />bulkhead outside the limits of the established bulkhead line on his property; <br />that the said Wellington G. Bosworth recently passed away bequeathing his <br />estate to Florida State University and to the University of Miami; that the <br />Florida First National Bank at Vero Beach, Executor of the estate, has <br />been unable to sell the property in question until the estate can pass title to <br />all of the property; that the proposed bulkhead line change will not involve <br />any filling or dredging and will not present any ecological or hydrographic <br />problems; that the proceeds from the sale of this property will be given to <br />Florida State University and the University of Miami, thereby benefiting the <br />citizens of the State of Florida and Indian River County, <br />NOW, THEREFORE, BE IT RESOLVED by the Board of County <br />Commissioners of Indian River County that the bulkhead line in a part of <br />Section 8, Township 31 South, Range 39 East, Indian River County, shall be <br />as follows: <br />" <br />
