OR <br />40 <br />RESOLUTION NO. 70-39 <br />WHEREAS, the Department of Health and Rehabilitative Services <br />of the State of Florida has, without warning or notice to the Indian River <br />County Health Department or the Board of County Commissioners. <br />reclassified Indian River County as a prohibited area for the taking of <br />shellfish for direct marketing, and <br />WHEREAS, such arbitrary action by the Department of Health <br />and Rehabilitative Services presents an economic emergency to Indian <br />River County, <br />NOW, THEREFORE, BE IT RESOLVED by the Board of County <br />Commissioners of Indian River County: <br />1. That said board requests the Department of Health and <br />Rehabilitative Services to immediately reclassify Indian River Qounty <br />as a conditionally approved area for the taking of shellfish. <br />2. That the Department's requested studies should be conducted <br />as rapidly as possible. <br />3. That all areas shall be classified and approved as soon as the <br />flow studies prove that this area cannot be adversely affected by abnormal <br />weather conditions. <br />4. That, in the event the Department will not approve Indian River <br />County unconditionally, that conditional approval be given for local <br />consumption only. <br />'5. That the Board of County Commissioners of Indian River <br />County is willing to assist the Department of Health in <br />Rehabilitative Services in any way possible to resolve this <br />matter as rapidly as possible. <br />6. That the Clerk of the Board will mail copies of this <br />Resolution to all interested parties. <br />
