M <br />The acquisition of the- site= by public agencies cons=titutes= s <br />substantial change in circumstances affecting the subject property <br />and meets the third criterion of Future Land Use Element Policy <br />13.3. Therefore, the proposed amendment is consistent with Future <br />Land Use Element Policy 13.3. <br />- Future Land Use Element Policy 1.4 <br />Future Land Use Element Policy 1.4 states that the Conservation <br />land use designations are applied to lands which play a vital or <br />essential role in the normal functioning -oi ecosystems, or merit <br />preservation as vestiges of once common 1county ecosystems. As an <br />important part of the Indian River Lagoon Estuary ecosystem, the <br />subject property meets both these criteria. For this reason, the <br />request is consistent with Future Land Use Element Policy 1.4. <br />- Future Land Use Element Policy 1.5 <br />Future Land Use Element Policy 1.5 limits the C-1 land use <br />designation to publicly owned land with conservation and/or <br />recreational uses. Since the site is publicly owned, and uses will <br />be limited to conservation and recreation, the property is eligible <br />for the C-1 land use designation. For this reason, the request is <br />consistent with Future Land Use Element Policy 1.5. <br />Future Land Use Element Objective 8 <br />Future- Land Use Element Objective" 8 states that the county will <br />preserve and protect archaeologically significant sites. The <br />subject property contains three archaeologically significant sites. <br />Since the proposed amendment works to ensure the preservation of <br />the subject property, the request implements Future Land Use <br />Element Objective 8. <br />- Future Land Use Element Objective 15 <br />Future Land Use Element Objective 15 states that the county shall <br />encourage land uses which complement and enhance the Indian River <br />Lagoon. By prohibiting development on the subject property, except <br />for that which is associated with passive recreational uses, the <br />proposed amendment will implement Future Land Use Element Objective <br />15. <br />- Conservation Element Policy 6.3 <br />Conservation Element Policy 6.3 involves the need to acquire and <br />properly maintain Coastal/Tropical Hammock. While public <br />acquisition of the Coastal/Tropical Hammock on the site has been <br />accomplished, the proposed amendment will work to ensure the <br />continued preservation of the hammock. For that reason, the <br />proposed amendment is consistent with Conservation Element Policy <br />6.3. <br />As part of the staff analysis, all policies in the comprehensive <br />plan were considered. Based upon this analysis, staff determined <br />that the proposed land use designation amendment is consistent with <br />the comprehensive plan. <br />47 <br />October 24, 1995 <br />booK 96 � JE :3 . <br />
