IRC -1639 <br />waives any claim to damages, of any kind whatsoever, in the event the Owner exercises its right to <br />cancel the award in accordance herewith. <br />19.02 More than one Bid for the same Work from an individual or entity under the same or different <br />names will not be considered. Reasonable grounds for believing that any Bidder has an interest in <br />more than one Bid for the Work may be cause for disqualification of that Bidder and the rejection of <br />all Bids in which that Bidder has an interest. <br />19.03 In evaluating Bids, OWNER will consider whether or not the Bids comply with the prescribed <br />requirements, and such alternates, unit prices and other data, as may be requested in the Bid Form <br />or prior to the Notice of Award. <br />19.04 In evaluating Bidders, OWNER will consider the qualifications of Bidders and may consider <br />the qualifications and experience of Subcontractors, Suppliers, and other individuals or entities <br />proposed for those portions of the Work for which the identity of Subcontractors, Suppliers, and <br />other individuals or entities must be submitted as provided in the Supplementary Conditions. <br />19.05 OWNER may conduct such investigations as OWNER deems necessary to establish the <br />responsibility, qualifications, and financial ability of Bidders, proposed Subcontractors, Suppliers, <br />individuals, or entities to perform the Work in accordance with the Contract Documents. <br />19.06 If the Contract is to be awarded, OWNER will award the Contract to the Bidder whose Bid <br />is in the best interests of the Project. <br />19.07 OWNER has no local ordinance or preferences, as set forth in FS 255.0991 (2) in place, <br />therefore no preference prohibited by that section will be considered in the acceptance, review or <br />award of this bid. <br />19.08 Any actual or prospective bidder or proposer who is aggrieved in connection with the <br />bidding and/or selection process may protest to the OWNER's Purchasing Manager. The protest <br />shall be submitted in writing to the Purchasing Manager within seven (7) calendar days after the <br />bidder or proposer knows or should have known of the facts giving rise to the protest. <br />19.09 CONTRACTOR certifies that it and its related entities as defined by Florida law are not on <br />the Scrutinized Companies that Boycott Israel List, created pursuant to s. 215.4725 of the Florida <br />Statutes, and are not engaged in a boycott of Israel. In addition, if this agreement is for goods or <br />services of one million dollars or more, CONTRACTOR certifies that it and its related entities as <br />defined above by Florida law are not on the Scrutinized Companies with Activities in Sudan List <br />or the Scrutinized Companies with Activities in the Iran Petroleum Energy Sector List, created <br />pursuant to Section 215.473 of the Florida Statutes and are not engaged in business operations <br />in Cuba or Syria. <br />OWNER may terminate this Contract if CONTRACTOR is found to have submitted a false <br />certification as provided under section 287.135(5), Florida Statutes, been placed on the <br />Scrutinized Companies with Activities in Sudan List or the Scrutinized Companies with Activities <br />in the Iran Petroleum Energy Sector List, or been engaged in business operations in Cuba or <br />Syria, as defined by section 287.135, Florida Statutes. <br />OWNER may terminate this Contract if CONTRACTOR, including all wholly owned subsidiaries, <br />majority-owned subsidiaries, and parent companies, that exist for the purpose of making profit, is <br />found to have been placed on the Scrutinized Companies that Boycott Israel List or is engaged <br />in a boycott of Israel as set forth in section 215.4725, Florida Statutes. <br />Instructions to Bidders - 00200 - 10 <br />F:\PublicWorks\ENGINEERING DIVISION PROJECTS\1639 69th Street 66th Avenue to US -1 Resurfacing (SCOP)\1-Admin\Bids\Bid Documents - Advertisement\DIV <br />0_1_Bidding Documents - 20210824.docx <br />
