Cox, P.E.° <br />Civil Engineer CONSENT AGENDA <br />SUBJECT: Request for Floodplain Cut and Fill Balance Waiver for <br />Residence at 9210 44th Avenue, Tax Parcel I.D. No. 28-31- <br />39-00000-0010-00008.0 <br />REFERENCE: Project No. 95090048 <br />DATE: October 19, 1995 <br />DESCRIPTION AND CONDITIONS <br />Mrs. Roberta Tomberg has submitted a building permit application <br />for a single family residence on -the subject property, and has <br />requested a waiver of the cut and fill balance requirement of <br />Section 930.07(2)(d) of the Stormwater Management and Flood <br />Protection Ordinance. The site is located in special flood hazard <br />area Zone AE with base flood elevation of 10.0 ft. N.G.V.D. The <br />ten year flood elevation is 5.0 ft. N.G.V.D. The proposed <br />displacement of the floodplain below 5.0 ft. for which the waiver <br />is requested is 547 cubic yards as indicated in the attached letter <br />from the applicant's engineer -dated October 19, 1995. <br />ALTERNATIVES AND ANALYSIS <br />The project meets the cut and fill balance waiver criteria provided <br />in Section 930.07(2)(d)1. of being situated in an estuarine <br />environment within the 100 year floodplain along the Indian River <br />and in staff's opinion is appears that all other Stormwater <br />Management and Flood Protection Ordinance requirements can be met <br />withour adverse impact on other lands in the estuarine environment. <br />Alternative No. --I <br />Grant the cut and fill waiver based on the criteria of Section <br />930.07 (2) (d) 1. <br />Alternative No. 2 <br />Deny the cut and fill waiver. Require an on site retention area be <br />provided to compensate for the proposed floodplain displacement. <br />RECOMMENDATION <br />Staff recommends approval of Alternative No. 1. <br />NOVEMBER 7, 1995 14 <br />
