Dedication and Improvements: The LDRs do not require any <br />dedications or improvements connected with the proposed <br />development of this site. <br />RECOMMENDATION: <br />Based on the analysis performed, staff recommends that the Board of <br />County Commissioners grant special exception approval for the <br />requested tower with the following conditions: <br />1. Prior to site plan release, the applicant shall obtain a <br />county "airport construction permit". <br />2. Prior to site plan release, the applicant shall enter into an <br />agreement with the county which is acceptable to the county <br />attorney's office, to allow. use of the tower by other parties <br />when technically viable and feasible in relation to the Bell <br />South Mobility operations. <br />Commissioner Bird announced a conflict of interest and filed <br />the necessary form with the Clerk's office. He said his firm has <br />listings on several of the properties which are under consideration <br />and he would refrain from discussing this matter. Whereupon, <br />Commissioner Bird left the Commission Chambers. <br />MEMORANDUM OF VOTING CONFLICT FORM 8B <br />IS ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD <br />County Attorney Vitunac swore the witnesses and asked them to <br />confirm that they had been sworn when speaking. <br />Planning Director Stan Boling presented the project to the <br />Board. <br />The Chairman opened the public hearing and asked if anyone <br />wished to be heard in this matter. <br />Attorney Bruce Barkett, special counsel for BellSouth, <br />introduced Gil Pastoresa, attorney for BellSouth and Geoff Sluggett <br />with Unruh Smith & Associates. Mr. Barkett explained that the need <br />is to enlarge cellular phone reception. The proposed location is <br />very compatible to the use and is bordered on the west by I-95 and <br />on the east by 90th Avenue. This is an industrial area. Several <br />of the neighbors have expressed concern as to how the transmissions <br />might affect other equipment but these transmissions are very low <br />power. Some of these towers are located where radar is calibrated <br />with no effect, such as highway patrol locations.
