PI <br />DIRECTOR OF UTILITY VICES <br />PREPARED WILLIAM F MC IN <br />AND STAFFED CAPITAL P E S INEER <br />BY: DEPAR LITY SERVICES <br />SUBJECT: FLORJffEAST COAST RAILWAY (F.E.C.) LEASE <br />AGRBEFIENT, SEBASTIAN WATER CONNECTIONS, IRC. PROJECT <br />NO. UW -95 -13 -DS <br />BACKGROUND AND ANALYSIS <br />On August 8, 1995, the Indian River County Board of County <br />Commissioners approved the above -referenced project. (See <br />attachment) The water main unavoidably must cross the railway, <br />which crosses Stratton Avenue. In order to receive a crossing <br />easement, the lease agreement between Indian River County and <br />F:E.C. for said easement must be executed and returned to F.E.C. <br />for their execution. Indian River County will then receive a <br />-fully.-executed agreement. <br />RECOMMENDATION <br />The staff of the Department of Utility Services recommends that the <br />Board of County Commissioners execute the attached agreements with <br />F.E.C. so that the project may continue. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board unanimously approved <br />the License Agreement with Florida East Coast <br />Railway Company for a subgrade crossing of the <br />Railway's 100 foot right-of-way at Stratton Avenue, <br />Sebastian, Florida, as recommended by staff. <br />AGREEMENT IS ON FILE IN THE OFFICE OF THE <br />CLERK TO THE BOARD <br />NOVEMBER 7, 1995 52 <br />
