County staff could not have committed to <br />purchasing any right-of-way at the February 23, 1995, meeting as <br />staff does not have the authority to spend $220,000 without the <br />approval of the Board. <br />Commissioner Bird questioned the potential for a reimbursement <br />from the State for the US #1 right-of-way which is the major <br />portion of the -property, and Director Davis responded that there is <br />no guarantee that the FDOT will participate in a reimbursement. <br />The developer tore down a restaurant and a hotel and made a <br />business decision in this project. The developer was given a <br />credit toward impact fees for the properties torn down. <br />Commissioner Bird wondered if any appraisal had been done, and <br />Director Davis responded that it had not. <br />Director Davis believed that the County is now faced with <br />making a decision "after the fact". <br />Commissioner Bird felt that an appraisal should be obtained to <br />assist the Board in making a decision. <br />County Attorney Vitunac suggested that the Board could make a <br />settlement offer, and Attorney Henderson, Mr. West and Mr. McGuire <br />left the room to discuss the matter. <br />Attorney Henderson, Mr. West and Mr. McGuire returned to <br />Chambers and Attorney Henderson advised the Board that the <br />developer would be willing to accept $13 per square foot for 60 <br />feet on 17th Street and 20 feet on US #1. <br />Director Davis confirmed that 139,945 square feet was the <br />correct amount. <br />Commissioner Bird wanted to be sure that staff would attempt <br />to obtain reimbursement from the FDOT for the right-of-way on US <br />#1, and Director Davis agreed that staff would follow up on this. <br />Chairman Macht questioned an assertion by the developer that <br />the additional land purchase was made because of a directive by <br />County staff to acquire some right-of-way which was subsequently <br />not needed. <br />Director Davis advised that the backup material includes a <br />letter from City of Vero Beach Planning Director Dennis Ragsdale <br />written on October 6, 1995, referencing the meeting of February. 23, <br />1995. Mr. Ragsdale indicated a reduced right-of-way might be <br />possible and suggested a meeting to discuss the matter. <br />Chairman Macht felt that supported staff's original contention <br />of notification to the developer. <br />Commissioner Adams commented that business and government <br />operate in very different modes.
