<br />Resolution No. 73-6
<br />WHEREAS, the Tax Collector of Indian River County did
<br />heretofore sell the following Tax Certificates, to wit:
<br />Numbers 176, 177, 178, 179, 211, 212, 213, 215, 261
<br />262, 263 and 266 for unpaid taxes on the following described
<br />land, to wit:
<br />Section 33, Township 31 South, Range 39 East-West 1/2
<br />of Northeast 1/4 of Northwest 1/4 less to Sykes, and
<br />containing 19 acres more or less, and recorded in the
<br />Deed Book Records of Indian River County, Florida, in
<br />Deed Book 1 at pages 203 and 243;
<br />Section 33, Township 31 South, Range 39 East-Northest
<br />1/4 of Northwest 1/4 less Bickers, Evens and Polite;
<br />Southeast 1/4 of Northwest 1/4 less Gaines, and con-
<br />taining 72 acres more or less and recorded in the
<br />Deed Book of Records of Indian River County, Florida, in
<br />Deed Book 1 at pages 203 and 243;
<br />Section 33, Township 31 South, Range 39 East -Southwest
<br />1/4 of Northwest 1/4 less Bickers and containing 28.13
<br />acres, more or less;
<br />Section 33, Township 31 South, Range 39 East -Southwest
<br />1/4 of Northeast 1/4 and Northwest 1/4 of Southeast
<br />1/4, less Duda and Taylor, and containing 62.53 acres
<br />more or less, and recorded in the Deed Book 3 at Page
<br />59, and
<br />WHEREAS, 3/4 of said land was owned by the United States
<br />government and was not subject to taxes, and
<br />WHEREAS, Federal District Judge C. Clyde Atkins did declare
<br />in Case No. 70-1897, UNITED STATES OF AMERICA VS. MRS. JOHN TYKVORT,
<br />etal, that said Tax Certificates were void as to the 3/4's interest
<br />of the United States and did further order Indian River County
<br />to refund to the purchasers of said Tax Certificates 3/4's of the
<br />amount paid, and
<br />WHEREAS, Judge Atkins did further order that from the proceeds
<br />of the sale of land the Tax Collector of Indian River County
<br />be paid 1/4 of the taxes due: Now, therefore,
<br />BE IT RESOLVED by the Board of County Commissioners of Indian
<br />River County, Florida, that the Lstate of Joe L. Burton, holder
<br />of Tax Certificates 261, 262, 263, and 266 be paid from the
<br />appropriate fund $1,996.15 and said Certificates cancelled.
<br />Further that WHR Company holders of Certificates 176, 177, 178
<br />179, 211, 212, 213 and 214 be paid from the appropriate fund
<br />$4,574.62 and said Certificates cancelled.
