necessary to such systems and includes every person, corporation,
<br />lessee, trustee or receiver owning, operating, managing or con-
<br />trolling a utility system or proposing construction of a system or
<br />who is providing or proposes to provide water or sewer service to
<br />the public.
<br />SECTION 3
<br />There is hereby granted by the County to the Company the
<br />exclusive franchise, right and privilege to erect, construct,
<br />operate and maintain a sewer system within the prescribed terri-
<br />tory as herein provided and for these purposes to sell sewerage
<br />collection and treatment services within the territory and for
<br />these purposes to establish the necessary facilities and equipment
<br />and to lay and maintain the necessary lines, pipes, mains and other
<br />appurtenances necessary therefor in, along, under and across the
<br />public alleys, streets, roads, highways and other public places
<br />of the County; provided, however, that the County reserves the
<br />right to permit the use of such public places for any and all
<br />other lawful purposes and subject always to the paramount right
<br />of the public in and to such public places.
<br />SECTION 4
<br />The territory in which this franchise shall be applicable
<br />is all that part of Indian River County, Florida, located within
<br />the following described boundary lines, to -wit:
<br />All of Government Lot 1, excepting the North 50
<br />feet thereof, Section 7.7, Township 33 South, Range
<br />40 East, and all of Government Lot 1, Section 28,
<br />Township 33 South, Range 40 East (including all of
<br />The Moorings, Units 1 and 2, per plats thereof
<br />filed in the office of the Clerk of the Circuit
<br />Court of Indian River County, Florida); all of
<br />Government Lot 2, Section 28, Township 33 South,
<br />Range 40 East, and all of Government Lot 2,
<br />Section 27, Township 33 South, Range 40 East
<br />(including all of The Moorings, Units 1 and 2, per
<br />plats thereof filed in the office of the Clerk of
<br />the Circuit Court of Indian River County, Florida);
<br />all of Government Lot 6, Section 21, Township 33
<br />South, Range 40 East, lying Westerly of Floralton
<br />Beach Subdivision (including all of The Moorings,
<br />Unit 2, lying within said Government Lot); all of
<br />Government Lot 5, Section 21, Township 33 South,
<br />Range 40 East, lying Westerly of State Road A -1-A;
<br />that part of Government Lots 2 and 3, Section 21, `
<br />Township 33 South, Range 40 East, lying Westerly i
<br />of State Road A -1-A; and that part of Government i
<br />Lots 1 and 4, Section 2.1, Township 33 South, Range
<br />40 East, lying Westerly of State Road A -1-A. {
