RESOLUTION 2022- 027 <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, <br />FINDING THAT THE SALE OF THE FIRE TOWER AT FIRE <br />STATION #13 TO THE CITY OF FELLSMERE IS IN THE <br />BEST INTERESTS OF THE CITIZENS OF INDIAN RIVER <br />COUNTY, FLORIDA <br />WHEREAS, the County owns a fire tower located at Fire Station #13, 4440 4 t <br />Street in Indian River County; and <br />WHEREAS, the County no longer desires to maintain the fire tower property; and <br />WHEREAS, the City of Fellsmere is seeking to have the tower removed from the <br />property and delivered to the City of Fellsmere to be rebuilt and maintained by the City <br />of Fellsmere within the City limits; and <br />NOW, THEREFORE BE IT RESOLVED, BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />1. The City of Fellsmere has applied to Indian River County seeking <br />ownership of the fire tower and the fire tower serves no county purposes. <br />2. It is in the best interest of the health, safety and welfare of citizens of <br />Indian River County to sell the fire tower located at Fire Station #13 to the City of <br />Fellsmere for no fee so that the City of Fellsmere can erect and preserve the tower <br />within its City limits. <br />3. Staff is hereby directed to take whatever additional steps are necessary to <br />effectuate the transfer of the fire tower to the City of Fellsmere, including removing the <br />fire tower and delivering it to a mutually agreeable location as determined by the City of <br />Fellsmere and County staff. Upon delivery of the fire tower to a mutually agreeable <br />location this Resolution shall constitute a Bill of Sale transferring ownership of the Fire <br />Tower to the City of Fellsmere. <br />4. This Resolution is being made pursuant to Section 125.38, Florida <br />Statutes. <br />This resolution was moved for adoption by Commissioner Flescher , and the <br />motion was seconded by Commissioner Adams and upon being put to a vote, <br />the vote was as follows: <br />Chairman Peter D. O'Bryan AYE <br />Vice Chairman Joseph H. Earman AYE <br />Commissioner Susan Adams AYE <br />Commissioner Joseph E. Flescher AYE <br />Commissioner Laura Moss AYE <br />1 <br />
