Prado, Assistant County Attorney <br />10A <br />Public Hearing: 04.12.2022 <br />Ofce of <br />INDIAN RIVER COUNTY <br />MEMORANDUM <br />TO: Board of County Commissioners <br />FROM: Susan Prado, Assistant County Attorney <br />DATE: April 5, 2022 <br />ATTORNEY <br />SUBJECT: Public Hearing for Amendment to Section 312.11 (Performance Security) of Chapter 312 <br />(Rights -of -Way) of the Indian River Code of Ordinances. <br />On March 15, 2022, the Indian River County Board of County Commissioners ("Board") heard a proposal <br />from Staff concerning a proposed change to Section 312.11 (Performance Security) of Chapter 312 <br />(Rights -of -Way) of the Indian River Code of Ordinances (the "Code"). The proposed change would allow <br />for the use of letters of credit as security for work in the County right-of-way. By a vote of 5 - 0, the <br />Board directed staff to advertise and schedule a public hearing on the proposed draft ordinance. <br />The County Attorney's Office has advertised the public hearing. The County Attorney's Office <br />recommends that the Board, after conducting the public hearing and taking any public input, approve the <br />draft ordinance. <br />FUNDING. <br />The only impact to County funds for this item is the cost of $126.54 to advertise for the public hearing and <br />is being paid from Account No. 00110214-034910 (General Fund/County Attorney/Legal Ads). <br />RECOMMENDATION. <br />The County Attorney's Office recommends that the Board, after conducting the public hearing and taking <br />any public input, approve the draft ordinance. <br />ATTACHMENT. <br />Attachment: Proposed Ordinance Amendment <br />Copies to: Rich Szpyrka, Public Works Director <br />98 <br />
