This proposal details the scope of work included in the above price. If any conditions are <br />found upon commencement of the work requiring additional repairs, ie underneath the liner, <br />work will stop until such time that the owner has been notified of the additional work <br />required, and has been provided with and agreed to the cost for the additional materials and <br />labor necessary to complete the work. <br />4. Demo, civil works, site works, excavation & hauling, concrete works, sealing, backfill, <br />deck construction, coping, electrical works, grounding works, mechanical works, and <br />commissioning works are not included in this price, unless specifically noted. <br />5. North County Aquatic Center has agreed to and acknowledged to forever release, hold <br />harmless and indemnify A & W Flooring, Inc. of and from any and all losses, liability <br />(including liability for personal injury or property damage), claims, liens, demands, damages <br />(including consequential, incidental and punitive damages and attorney fees) and causes of <br />action relating to or arising from work performed or materials supplied by A & W Flooring, <br />Inc. Same applies to any subcontractor used for Dewatering, outside the scope of work of A & <br />W Flooring, Inc. A & W will not be held responsible for anything once the pool has been <br />drained. North County Aquatic Center is responsible for draining and refilling the pool. <br />6. Project Repair date will be contingent upon all materials are shipped and on jobsite, and <br />weather is not a factor of delay, otherwise a possible date change could be required. A & W <br />Flooring, Inc. will not be responsible for liquidated damages per day thereafter if delay is <br />caused by natural disasters, weather or a delay of material shipment. Project estimated 5 <br />weeks for completion. Material Delivery is between 45 - 60 days from written approval of <br />scope. <br />7. Permitting will be responsibility of others, not A & W Flooring, Inc.
