J.R. SMITH, CLERK <br />ARTICLE 11 <br />CASUALTY <br />Section 11.1. Notice to LESSOR. <br />If the Premises, or any improvement thereon, is damaged or destroyed by fire, hurricane, <br />tornado, or any other casualty, LESSEE shall promptly give written notice to LESSOR of the date <br />and nature of such damage. <br />Section 11.2. Damage Due to Insurable Cause within Term, or Minor Damage. <br />If any improvements on the Premises are damaged and: <br />(a) such damage: (1) occurs by fire, hurricane, tornado, or other casualty of the type which <br />LESSEE is required to provide coverage for, or which is covered by any insurance policy carried by <br />LESSEE; and (2) occurs within the Term (as set forth in Section 2.1 above); or <br />(b) any building or buildings are damaged so as to collectively require, for Restoration, as defined <br />below, an estimated expenditure of not more than ten percent (10%) of the full insurable value of all <br />buildings on the Premises immediately prior to the casualty (as determined by an "Independent <br />Architect" as defined below); <br />then: <br />1) LESSEE shall, at its own cost and expense, promptly repair, replace, and rebuild it, at <br />least to the extent of the value and as nearly as practicable to the character of the <br />Premises and improvements existing immediately prior to the occurrence of such <br />damage (the "Restoration"); <br />Page 20 of 41 <br />
