Stv11TH, CLERK <br />between the LANDLORD and the TENANT based upon the time period left in the Lease <br />Agreement before the reversion of all structures and improvements (fixtures) to the <br />LANDLORD (example: if LANDLORD consents to TENANT'S request not to repair <br />and/or replace and the lease is in the 28'h year of a 30 year lease, the insurance <br />proceeds would be dispersed 28/301" to the LANDLORD and 2/30`h to the TENANT). <br />As soon as is reasonably possible after damage and/or destruction to the <br />buildings, improvements, betterments and equipment, but no later than 18 months after <br />said damage and/or destruction, TENANT shall, at the TENANT'S sole expense (using <br />insurance proceeds available for that purpose, along with TENANT'S own funds), <br />commence to either repair or restore the buildings, improvements, betterments and <br />equipment as completely as possible to their condition immediately prior to the damage, <br />or, in the alternative, replace the structures, improvements, betterments and equipment <br />with structures approved in advance, in writing, by LANDLORD. <br />In the event any insurance proceeds of such policy shall remain unused after the <br />completion of restoration or rebuilding to the LANDLORD'S satisfaction, evidenced in <br />writing, and if the TENANT shall not be in default under the Lease Agreement, then the <br />remaining funds shall be paid to LANDLORD for any unpaid rent and other sums due, <br />with any remaining sum paid to the TENANT. <br />(c) All insurance required by this Section shall be with a company licensed to <br />do business in the state of Florida, and be otherwise satisfactory to the LANDLORD. <br />(d) Recognizing the extended term of the Lease Agreement, TENANT agrees <br />that the LANDLORD shall have the right to periodically review the adequacy of the <br />required insurance and amend the insurance requirements of this section.
