SMITH, CLERK <br />paragraph (f) shall not apply to properly permitted storage, if any, allowed under the <br />terms of the Lease Agreement. <br />(g) The TENANT shall store, utilize, and dispose of all industrial, domestic, <br />hazardous, and solid wastes permitted under the terms of the Lease Agreement in <br />accordance with applicable federal, state, and local laws, rules, and regulations. <br />(h) TENANT shall immediately provide LANDLORD verbal notice of any spill <br />or release of hazardous materials at or from the Leased Premises. TENANT shall <br />promptly confirm the verbal notice to LANDLORD in writing providing the details of such <br />spill or release and the remediation taken by TENANT. <br />(i) TENANT shall not install or utilize any irrigation wells on the Leased <br />Premises. <br />0) In the event that any environmental condition arises on the Leased <br />Premises or any hazardous materials prohibited by or actionable under applicable law <br />should now or hereafter contaminate, or be located on the Leased Premises, except for <br />pre -occupancy events as described in Paragraph (k) of this section, TENANT hereby <br />agrees, at its expense, to immediately (1) remove said materials from the Leased <br />Premises; (2) comply with any and all orders or directives of any federal, state, or local <br />agency or department relative thereof; and (3) return the Leased Premises to its pre- <br />existing condition without any diminution in the value thereof. <br />(k) As used herein, "pre -occupancy event' shall mean any condition, <br />occurrence, or event, including, but not limited to, a spill, the storage, disposal, or use of <br />a hazardous material or waste as defined by federal, state or local law, ordinance, rule <br />or regulation, occurring prior to the commencement date of the Lease Agreement and <br />not caused by TENANT, whether originating on or off of the Leased Premises, whether <br />Page 29 of 38 <br />N:\Client Docs\Airport\Attachment B\2016.February.16.ATTACHMENT B.docx <br />
