SMITH, CLERK J R. u, CLERK <br />its status active and current throughout the term of the Lease Agreement and renewal. <br />Failure of TENANT to keep its status active and current shall constitute a default. <br />{f) LANDLORD reserves the right to develop, improve, repair, and alter the <br />Airport and all roadways, parking areas, terminal facilities, landing areas, and taxiways <br />as it may deem appropriate, free from any and all liability to TENANT for TENANT'S <br />loss of business or damages of any kind or nature whatsoever arising out of or <br />connected to the making of such improvements, repairs, and alterations. <br />(g) Any construction, reconstruction, remodeling, installation of improvements, <br />or other work done to the Leased Premises by TENANT shall be performed in <br />compliance with the requirements of the Americans with Disabilities Act ("ADA"), at <br />TENANT'S expense. In the event that a regulatory agency, private party, organization, <br />or any other person or entity makes a claim under the ADA against either (or both) <br />parties, the party whose breach (or alleged breach) of responsibility under this Lease <br />Agreement gave rise to the claim shall, in good faith and at that party's sole cost, <br />promptly take whatever actions are necessary to bring the Leased Premises into <br />compliance with ADA requirements. That party shall defend, save, and hold harmless <br />the other party from any and all expenses incurred in responding to such a claim, <br />including without limitation the fees of attorneys and other advisors, court costs, and <br />costs incurred for bringing the Leased Premises into compliance. <br />(h) The captions and paragraphs or letters appearing in this Attachment B <br />and the Lease Agreement are inserted only as a matter of convenience and in no way <br />affect, define, limit, construe, or describe the scope or intent of the sections or articles of <br />this Attachment B and the Lease Agreement. <br />Page 37 of 38 <br />N:\Client Docs\Airport\Attachment B\2016.February.16.ATTACHMENT B.docx <br />
