BEFORE THE BOARD OF COUNTY COMMISSIONERS <br />MARTIN COUNTY, FLORIDA <br />ORDINANCE NO. 1173 <br />AN ORDINANCE OF MARTIN COUNTY, FLORIDA; PROVIDING FOR <br />LOCAL IMPLEMENTATION OF THE SOUTH FLORIDA WATER <br />MANAGEMENT DISTRICT'S RULE FOR MANDATORY YEAR-ROUND <br />LANDSCAPE IRRIGATION CONSERVATION MEASURES (40E-24, <br />FLORIDA ADMINISTRATIVE CODE); PROVIDING DEFINITIONS; <br />PROVIDING FOR THE APPLICABILITY OF THE ORDINANCE; <br />PROVIDING THE LANDSCAPE IRRIGATION SCHEDULE; PROVIDING <br />EXCEPTIONS TO THE LANDSCAPE IRRIGATION SCHEDULE; <br />PROVIDING FOR ADMINISTRATIVE VARIANCES FROM THE <br />SPECIFIC DAY OF THE WEEK LIMITATIONS; PROVIDING FOR <br />ENFORCEMENT OF THE ORDINANCE; PROVIDING FOR THE <br />DECLARATION OF A WATER SHORTAGE OR WATER SHORTAGE <br />EMERGENCY; PROVIDING FOR APPLICABILITY, CONFLICTING <br />PROVISIONS, SEVERABILITY, FILING WITH THE DEPARTMENT OF <br />STATE, CODIFICATION, AND AN EFFECTIVE DATE. <br />WHEREAS, Martin County through its Board of County Commissioners desires its <br />businesses, residences and public places to conserve water resources on a year-round basis; and <br />WHEREAS, Martin County recognizes that the South Florida Water Management District <br />("District") has amended Chapter 40E-24, Florida Administrative Code ("F.A.C.") to implement <br />the Rule for Mandatory Year -Round Landscape Irrigation Conservation Measures (the "Rule"); <br />"ITIJ <br />WHEREAS, the District is encouraging local governments within the District's sixteen <br />county region to adopt year-round irrigation conservation ordinances for landscape irrigation <br />pursuant to the Rule; and <br />WHEREAS, Martin County desires to adopt this Ordinance applicable to landscape <br />irrigation, as an effective way to conserve water resources and to comply with the Rule; and <br />WHEREAS, Martin County finds and declares that the adoption of this Ordinance is <br />appropriate, and in the public interest. <br />Added language is underlined: deleted language is sfowel-ik+augh <br />
