BOOK 96 PAGE 639 <br />recommendation gives the county less concurrency flexibility, this <br />alternative will ensure that any traffic congestion and quality of <br />life impacts will be of shorter duration. At the same time, <br />development projects can be approved, and growth will not be <br />restricted. And over a longer timeframe, level -of -service <br />standards will be adequate. <br />CONCLUSION <br />The proposed amendments will enhance the plan by updating the <br />Traffic Circulation and Capital Improvement Elements to reflect new <br />conditions and information, as well as changes to state law. The <br />analysis also demonstrates that these amendments will maintain the <br />plan's internal consistency. For these reasons, staff supports the <br />adoption of the proposed amendments. <br />RECOMMENDATION <br />Based on the analysis, staff recommends that the Board of County <br />Commissioners transmit the proposed amendments to the State <br />Department of Community Affairs for their review. <br />Community Development Director Robert Keating reviewed the <br />Comp Plan amendment process, advising that this is the first public <br />hearing before the Board of County Commissioners on this land use <br />amendment request. If the Board approves the transmittal of this <br />application to the Department of Community Affairs (DCA) in <br />Tallahassee for their 90 -day review, a second and final public <br />hearing will be scheduled to consider any comments made by the DCA <br />and whether to adopt an ordinance amending the Comp Plan by <br />redesignating the land use. If the Board denies the transmittal of <br />an application to the DCA, the application process will come to an <br />end. This is a text amendment to the Comp Plan to assist in <br />designating CR -510 and CR -512 as arterial instead of collector <br />roads. The County now has some flexibility for planning capital <br />improvements and a portion of the amendment would provide that the <br />capital improvements completion date can be as long as 3 years <br />after issuance of the certificate of occupancy. The Planning & <br />Zoning Commission felt 3 years was too long and recommended using <br />1 year. Staff's recommendation at this time is also that not more <br />than 1 year be allowed after issuance of the certificate of <br />occupancy for commencement of construction. <br />Commissioner Eggert felt the County should know prior to <br />issuance of a certificate of occupancy whether or not the road <br />could be built. She wondered whether DCA could force the County to <br />build the roads, and Director Keating did not know the extent of <br />their powers. <br />County Attorney Vitunac emphasized that if the County does not <br />carry through on construction of the roads, the burden should not <br />revert to the developer. <br />Commissioner Adams agreed that these projects normally fall <br />behind schedule because of unexpected delays and felt that it was <br />NOVEMBER 21, 1995 36 <br />
