Szpyrka, P.E., Public Works Director <br />SUBJECT: 11th Drive Project Construction Inspection Cost Share Approval <br />DATE: June 13, 2022 <br />DESCRIPTION AND CONDITIONS <br />On October 22, 2019 the Board approved the 11th Drive Developers Agreement with Virginia <br />W. Russell Family, Ltd. ("Russell") and Riverfront Groves, Inc., for the dedication of right of <br />way, design, permitting and construction of 11thDrivefromthesouthern boundaryofthe Russell <br />property to 411Street. The right-of-way dedication has occurred. <br />As part of the agreement Russell was to design, permit, and construct 11th Drive as a two-lane <br />roadwayfrom 41St Street to the southern point of the Russell property. All road construction is <br />to be in compliance with design plans and standards which will need to be approved by Indian <br />River County through the County right-of-way permitting process in accordance with Chapter <br />312 of the Indian River County Code of Ordinances. Once estimated costs for design, <br />permitting, and construction were available, staff was required to obtain Board approval to <br />proceed with cost sharing on the project. The total cost of design and permitting agreed to by <br />both parties is $116,175. The reimbursable cost, also agreed to by both parties, for the <br />roadway design is $93,210 that the County is responsible for and the Developer is responsible <br />for $22,965 of developer related improvements. <br />County staff and the Engineer also agreed on the engineers estimated construction cost of <br />$1,289,177.50 of the roadway. We also agree that the County portion of the construction cost is <br />$1,205,755.88 and the developer's portion is $83,421.62. <br />On February 4, 2020 the Board approved the 11th Drive Project Developer's Agreement for <br />cost sharing the costs above for the design, permitting, and construction of the project. <br />The project is now fully designed and permitted. The Developer has bid and awarded the <br />project per the Developer's Agreement requirements. As is true with all construction projects, <br />construction inspection of the project is required and the Developer has contacted the County <br />to cost share in these expenses. The cost of Construction Inspection Services for the project in <br />the amount of $77,888.00, plus reimbursable expenses, was obtained from Masteller & Moler, <br />Inc. The County's cost share will be 75% or $58,416.00 and the Developers share will be 25% or <br />$19,472.00 with reimbursable expenses being shared in the same manner. This cost share is <br />agreeable to Staff as it is consistent with sharing the costs for design, permitting and <br />construction of the project. <br />70 <br />
