agents, contractors, and invitees, except to the extent caused by negligence of <br />LESSOR (and/or its officers, agents, and employees); <br />2) any and all injury, loss, or damage, of any nature whatsoever, to any person or property <br />(including but not necessarily limited to contamination to the environment) in <br />connection with the installation, maintenance, repairs, and removal of any <br />underground storage tanks or other tanks; and <br />3) any and all fines or penalties imposed on LESSOR by any governmental agency <br />(including but not limited to the FAA and the TSA as a result of the failure of LESSEE <br />or its agents, employees, or contractors, to abide by or comply with any statute, <br />ordinance, rule, regulation, or other requirement (including, but not limited to, <br />environmental damage or breaches of the Airport's security). <br />LESSEE agrees to release LESSOR from any injury, loss, or damage, caused by criminal acts <br />of third parties. LESSEE agrees that LESSOR is not responsible or liable for any acts, errors, or <br />omissions of the TSA, FAA, or any other governmental agency. Nothing herein shall be interpreted <br />or construed to mean that either party waives its common law sovereign immunity or the limits of <br />liability set forth in Section 768.28, Florida Statutes. <br />ARTICLE 10 <br />INSURANCE REQUIREMENTS <br />LESSEE must procure and maintain during the LEASE Term at its own expense, for the <br />protection of LESSOR and LESSEE, in form satisfactory to LESSOR: <br />Section 10.1.
