CC 6.7.22 <br />Ofc of <br />INDIAN RIVER COUNTY <br />ATTORNEY <br />MEMORANDUM <br />TO: Board of County Commissioners <br />FROM: Dylan Reingold, County Attorney <br />DATE: June 1, 2022 <br />SUBJECT: On -Airport Lease and Aircraft Rescue and Firefighting (ARFF) Agreement <br />BACKGROUND. <br />On April 5, 2022, the Indian River County Board of County Commissioners ("Board") approved the On - <br />Airport Lease and Aircraft Rescue and Firefighting (ARFF) Agreement (collectively, the "Agreements") <br />with the City of Vero Beach. After the approval, City staff and Emergency Services District staff agreed <br />that it would be best to have the Agreements retroactive to October 1, 2021. This will actually result in a <br />greater increase in the payment to the Emergency Services District for ARFF services than the increase in <br />lease payments owed to the City of Vero Beach. <br />In order to memorialize the retroactive application of the Agreements, County staff recommends the <br />Board approve the revised Agreements, which reflect a date of October 1, 2021. Otherwise all other terms <br />of the Agreements remain unchanged. <br />FUNDING. <br />The City payment for ARFF funding will increase retroactively back to October 1, 2021, which represents <br />a difference of $2,552.50 per month or an increase of $22,972.50 through June 2022. The lease payment <br />to the City during that same time period will go unchanged. <br />RECOMMENDATION. <br />The County Attorney's Office recommends that the Indian River County Board of County Commissioners <br />approve the revised On -Airport Lease and Aircraft Rescue and Firefighting (ARFF) Agreement <br />retroactive to October 1, 2021. <br />ATTACHMENTS. <br />Agreement to Provide Aircraft Rescue and Firefighting Services, without Exhibits <br />On Airport Land Lease, without Exhibits <br />Memorandum of Land Lease Agreement, without Exhibits <br />C.
