1a,A,3 <br />MEMORANDUM <br />TO: Board of County Commissioners <br />FROM: Dylan Reingold, County Attorney <br />DATE: May 11, 2022 <br />SUBJECT: Children's Services Advisory Committee Ordinance <br />BACKGROUND. <br />After initially considering establishing a Children's Trust special dependent district, on March 1, 2022, the <br />Indian River County Board of County Commissioners ("Board") voted not to place the Children's Trust <br />special dependent district referendum on the November 2022 ballot. The Board did however vote to <br />direct the County Attorney's Office to move forward with an ordinance changing aspects of Part II <br />(Children's Services Advisory Committee) of Chapter 103 (Commissioners and Boards) of the Indian <br />River County Code of Ordinances (the "Code") to address many of the issues raised in the proposed <br />Children's Trust special dependent district ordinance. In addition to the changes previously addressed as <br />part of that process, the Board additionally directed the County Attorney's Office to include business <br />experience as a qualification for the community appointed members appointed by the Board. Also, the <br />Board included an increase in the millage cap from the current limit of 0.125 to 0.25. Pursuant to the <br />Board's direction, the County Attorney's Office made those revisions to the draft ordinance and scheduled <br />the matter for a public hearing on May 10th. On May 10th, the Board made several changes to the draft <br />ordinance involving membership and duties of the Children's Services Advisory Committee and the <br />various sub -committees. The Board then continued the public hearing until May 17th. The County <br />Attorney's Office has revised the ordinance to reflect those changes. The County Attorney's Office <br />recommends that the Chair open the public hearing, take any public comment, close the public hearing <br />and that the Board vote to approve the draft ordinance as revised. <br />FUNDING. <br />The cost associated with this item was the cost of publication of the notice of public hearing in the amount <br />of $135.09 which is paid from the County Attorney's Budget/Legal Ads; Account No. 00110214-034910. <br />RECOMMENDATION. <br />The County Attorney's Office recommends that the Chair open the public hearing, take any public <br />comment, close the public hearing and that the Board vote to approve the revised draft ordinance. <br />ATTACHMENT. <br />Revised Draft Ordinance <br />134 <br />
