The Board issued findings of fact, conclusions of law, and an oral order which <br />was reduced to writing and furnished to the Respondent(s) to take corrective action by a certain time, as <br />more specifically set forth in that order. <br />On February 27, 2017, this Board conducted a compliance hearing to determine whether the Board's <br />order of September 26, 2016, as amended by Orders Granting Extension, had been complied with. <br />Respondents were provided proper notice of the compliance hearing, but did not attend the hearing. <br />Based on the evidence and testimony presented at the hearing, this Board finds that the required <br />corrective action has not been taken as ordered and that there does in fact exist junk vehicles, junk, trash and <br />debris in the A-1 Zoning District, which constitutes the use of the property in violation of Section 973.03(2), <br />of the Code of Laws and Ordinances of Indian River County. <br />The Board's previous order, as amended, set forth a compliance date of February 24, 2017, and a <br />fine of $100 for each day the violation continues beyond the referenced compliance date. <br />IT IS HEREBY ORDERED THAT THE ABOVE DESCRIBED FINE IS HEREBY IMPOSED <br />AGAINST THE RESPONDENT(S) for each and every day the violation exists upon or adjacent to the <br />following described property, situated in Indian River County, Florida, to wit: <br />Location: 13498 99TH ST FELLSMERE <br />Tax Parcel ID No. 31-37-00-00001-1359-00007.0 <br />Legal Description: FELLSMERE FARMS COS SUB PBS 2-1&2 N 340 FT OF W 102.7 FT OF W <br />2.89 A OF TR 1359 AS IN R BK 120 PP 153 (OR BK 450 PP 666) <br />beginning February 25, 2017.
