RESOLUTION NO. 87-39_ <br />® A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAty RIVER COUNTY, FLORIDA, DESIGNATING THE COMMUNITY <br />DEVELOPMENT DIVISION DIRECTOR AS AN OFFICIAL <br />REPREESENTATIVE OF INDIAN RIVER COUNTY ENABLED TO ENTER <br />• INTO AGREEMENTS ON BEHALF OF INDIAN RIVER COUNTY FOR THE <br />RESERVATION OF ROAD RIGHT-OF-WAY; AND PROVIDING FOR AN <br />EFFECTIVE DATE <br />WHEREAS, the Board of County Commissioners of Indian River <br />County has adopted Ordinance #86-63 which amended Section 23.3 <br />"Site Plan Review Standards", of Appendix "A" of the Code of Laws <br />and Ordinances, known as the Zoning Ordinance; and <br />WHEREAS, Ordinance #86-63 permits owners of land involved in <br />minor site plans which lie on County streets and roads lacking <br />sufficient right-of-way as required in the Indian River County <br />Thoroughfare Plan, to place their share of deficient right-of-way <br />in reserve for future acquisition; and <br />WHEREAS, the Board of County Commissioners has determined <br />that it would be beneficial to expedite the acceptance process for <br />reservation of road right-of-way agreements by designating the <br />Director of the Community Development Division as an authorized <br />representative of Indian River County for accepting and executing <br />said agreements on behalf of Indian River County; <br />NOW, THEREFORE, BE IT RESOLVED by the Board of County <br />Commissioners of Indian River County, Florida that: <br />1. The foregoing recitals are adopted and ratified in their <br />entirety. <br />2. The Director of the Community Development Division is <br />designated an official of Indian River County empowered to accept <br />and execute reservation of road right-of-way agreements on behalf <br />of Indian River. County between the owners of land involved in <br />minor site plan projects and Indian River County, for the purpose <br />of reserving right-of-way for future acquisition. <br />
