5/6/87.2(Reso)LEGAL(Vk)TP <br />TV <br />RESOLUTION NO. 87-40 <br />• <br />A RESOLUTION OF INDIAN RIVER COUNTY TO THE ST. <br />JOHNS RIVER WATER MANAGEMENT DISTRICT PROTESTING A <br />WELL PERMIT APPLICATION BY BENT PINE UTILITIES CO. <br />• <br />WHEREAS, Indian River County operates wastewater <br />treatment facilities and is in the process of accepting a <br />Farmers Home Administration loan of some $9.2 million <br />dollars to expand and modernize the wastewater facilities; <br />and <br />WHEREAS, as part of this expansion it is necessary for <br />the County to properly dispose of highly treated effluent; <br />and <br />WHEREAS, the County has entered into an effluent <br />disposal agreement with Hawk's Nest Associates, Ltd. for the <br />disposal of this highly treated effluent for reuse as <br />Irrigation water on an existing golf course; and <br />WHEREAS, the Hawk's Nest Golf Course is located <br />irrmediately east of and contiguous to the service territory <br />for Bent Pine Utilities Co.; and <br />WHEREAS, Bent Pine Utilities Co. has applied for a <br />potable water well to be located within approximately 150 <br />feet of the common property line between Bent Pine's <br />development and the Hawk's Nest Golf Course; and <br />WHEREAS, the County objects to the siting of this well <br />since its proximity to the Hawk's Nest golf course may be <br />used to prohibit, restrict, or prevent the reuse of this <br />highly treated effluent on the Hawk's Nest Golf Course; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that the <br />Board respectfully registers its opposition to a grant of a <br />permit by the St. Johns River Water Management District to <br />Bent Pine Utilities Co. for the construction of a potable <br />water well near the property boundary with Hawk's Nest Golf <br />Course which would prohibit in any way the reuse of its <br />highly treated effluent for irrigation of all or any part of <br />the Hawk's Next golf course. <br />8 <br />
