RESOLUTION NO. 87- 120 <br />A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA, DESIGNATING A PARTICULAR <br />SIMPSONS STOPPER (Myrcianthes fragrans) TREE TO BE A <br />"SPECIMEN TREE," IN ACCORDANCE WITH SECTION 23}-5(n) <br />OF THE COUNTY TREE PROTECTION ORDINANCE NO. 83-41. <br />WHEREAS, tae Board of County Commissioners of Indian <br />River County recognizes that trees serve a valuable ecological <br />as well as aesthetic function, in the interest of the present <br />and future health, safety and welfare of the citizens of the <br />. County; and <br />WHEREAS, the Indian River County Tree Protection <br />Ordinance (No. 83-41) sets forth provisions to protect trees <br />identified to be of significant ecological and aesthetic value; <br />and <br />WHEREAS, Section 23}-5(n) of the Tree Protection <br />Ordinance defines "specimen tree" as " a tree which has been <br />determined by the county commission, following input from the <br />environmental planner, to be of high value because of its type, <br />size, age, or other relevant criteria, and has been so designa- <br />ted by the county commission in the official record books <br />following a public hearing with due notice by certified mail to <br />the owner"; and <br />WHEREAS, the American Forestry Association's National <br />Program of Big Trees recognizes a particular Simpsons Stopper <br />(Myrcianthes fragrans) tree in Indian River County to be the <br />largest of its kind reported in the United States; and <br />WHEREAS, said Simpsons Stopper is located on property <br />with Mr. Ty Tarby as trustee, such property being legally <br />described as: <br />EAST } OF THE NORTHWEST } OF THE NORTHWEST } <br />OF SECTION 05, TOWNSHIP 33 SOUTH, RANGE 39 <br />EAST, INDIAN RIVER COUNTY, FLORIDA; and <br />WHEREAS, Mr. Ty Tarby, the trustee of the property, <br />has been given due notice of the specimen tree hearing by <br />certified mail; and <br />WHEREAS, the Board of County Commissioners has <br />determined that said Simpsons Stopper qualifies to be designated <br />as a "Specimen tree" as defined in the County Tree Protection <br />Ordinance; and <br />1 <br />
