s <br />.HA, <br />-2- <br />Your attention is invited to Sections 30.301, 30.309 and 30.510 of EPA's <br />regulation 40 CFR 30 and Section 35.2104 of 40 CFR 35 and Sections 33.210, <br />33.211 and 33.220 of 40 CFR 33 which set forth the recipient's responsi- <br />bility for project management and procurement. Copies of these regulations <br />are enclosed. <br />You are advised that any planned procurement actions in excess of $10,000 <br />resulting in items available from a single or sole source must be procured <br />in accordance with Sections 33.110, 33.250, 33.275, 33.290, 33.605, and <br />Appendix A of 40 CFR 33. <br />After acceptance of this grant you may advertise for bids on the <br />construction of this project. You are cautioned not to advertise unless <br />you have a proper wage decision that will not expire before bids can be <br />received and a tentative contract award made. <br />The enclosed five copies of the Project Review and Cost Summary are to be <br />completed after bids have been received and submitted along with supporting <br />documents including a detailed cost breakdown showing the units, unit cost, <br />and value of the eligible work. The complete bid package should reach the <br />state offices within twenty-one (21) days after bid opening. Equal Employ- <br />ment Opportunity documentation to be provided by the successful bidder must <br />be submitted directly to EPA within fourteen (14) days after bid opening. <br />The State will authorize you to award contracts when these documents are <br />approved. <br />EPA has entered into an agreement with the Corps of Engineers for the <br />purpose of performing construction, engineering and administrative moni- <br />toring functions on Step 3 grant projects. Our interest in the assignment <br />of these functions is to assure that the overall objectives of the grant <br />are realized; that the grant and the project will be administered in <br />accordance with federal laws and EPA regulations; and that needed <br />assistance will be provided to you. Your project will be monitored by the <br />Orlando Project Office under this agreement. <br />Performance of these services by the Corps does not relieve you of <br />responsibility under the grant, nor does it relieve the consultant, <br />contractor, subcontractor or other party from any obligation imposed upon <br />them by federal laws, EPA regulations or other applicable requirements or <br />terms of contract agreements entered into as a result of this construction <br />grant. <br />
