r � � <br />Mr. Spicola, attorney for Mid -State Trust II is in the process of <br />restructuring the mortgage in order to allow the owners to stay in the <br />property in lieu of foreclosure. Mr. Spicola has asked the County to <br />accept $750.00 in satisfaction of the lien. He points out the Indian <br />River County lien is inferior to the first mortgage and the lien will <br />expire in five years. Additionally, it appears that the property is <br />homestead property. Letters from Mr. Spicola are attached. <br />In view of the foregoing, it appears that the chance of recouping the <br />lien with interest is remote. The offer of $750.00 is probably all that <br />will ever be realized. Accordingly, it would appear to be in the <br />County's best interest to accept the ,$750:00 and release the lien. <br />Recommendation: Accept partial payment and authorize the chairman to <br />execute a release of lien. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board unanimously agreed to <br />accept partial payment in satisfaction of the lien <br />against James White and authorized execution of a <br />release of lien, as recommended in the memorandum. <br />RELEASE WILL BE RECORDED <br />IN THE PUBLIC RECORDS OF INDIAN RIVER COUNTY <br />S. Vitunac, County Attorney <br />DATE: December 14, 1995 <br />RE: Letter of Understanding <br />Indian River Hospital District <br />The Hospital District . would like the Board of County Commissioners' <br />concurrence with the attached Letter of Understanding regarding medical <br />programs offered in this county.
