4/18/88.1(Reso)LEGAL(Vk) <br />RESOLUTION NO. 88-27 <br />A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA, TO THE <br />LEGISLATURE OF THE STATE OF FLORIDA REQUESTING <br />CERTAIN CHANGES TO §951.26, FLORIDA STATUTES, <br />RELATING TO COUNTY CORRECTIONAL PLANNING <br />COMMITTEES. <br />WHEREAS, Indian River County has been exercising its <br />Home Rule powers to plan and construct required correctional <br />facilities in close cooperation with the local judiciary, <br />State Attorney, and Public Defender; and <br />WHEREAS, §951.26, F.S., requires that a state -defined <br />committee meet not less than monthly whether there is a <br />demand for a monthly meeting or not; and <br />WHEREAS, the committee membership of local public <br />officials meets at great expense to the local taxpayers; and <br />WHEREAS, all members required to be on the committee <br />are allowed to have specified alternates except for the <br />county commission chairman, who alone has no alternate; and <br />WHEREAS, Indian River County is opposed in concept to <br />state interference in local government affairs; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that for the <br />foregoing reasons, Indian River County respectfully requests <br />that the Legislature of the State of Florida revise §951.26, <br />F.S., as follows: <br />1. Allow the board of county commissioners' chairman <br />to designate an alternate. <br />2. Allow the committee to meet at the call of the <br />committee chairman or a majority of the committee. <br />The foregoing resolution was offered by Commissioner <br />Eggert who moved its adoption.
