SECTION 00520 Agreement (Public Works) <br />THIS AGREEMENT is by and between INDIAN RIVER COUNTY, a Political Subdivision of the <br />State of Florida organized and existing under the Laws of the State of Florida, (hereinafter called <br />OWNER) <br />and C. W. Roberts Contracting, Inc. <br />(hereinafter called CONTRACTOR). <br />OWNER and CONTRACTOR, in consideration of the mutual covenants hereinafter set forth, agree <br />as follows: <br />ARTICLE 1 -WORK <br />1.01 CONTRACTOR shall complete all Work as specified or indicated in the Contract <br />Documents. The Work is generally described as follows: <br />This project will be performed for the resurfacing/widening of Indian River <br />Boulevard from 53rd Street to the Merrill Barber Bridge. The proposed <br />improvements will include milling and resurfacing, widening the shoulder to <br />guarantee a minimum 5 -foot -wide bike lane along a major North/South corridor, <br />ADA sidewalk return improvements and interconnect improvements for hardening <br />and resiliency. This project is an F.D. O. T. Small County Outreach Program (SCOP) <br />funded project, FM No. 441919-1-54-01. <br />ARTICLE 2 - THE PROJECT <br />2.01 The Project for which the Work under the Contract Documents may be the whole or only a <br />part is generally described as follows: <br />Project Name: INDIAN RIVER BOULEVARD RESURFACING FROM 53RD <br />STREET TO THE MERRILL BARBER BRIDGE <br />County Project Number: IRC -1707 <br />FM Number: 441919-1-54-01 <br />Bid Number: 2022046 <br />Project Address: Indian River Blvd. from 53rd Street to the Merrill Barber Bridge, <br />Vero Beach, Florida 32960 and 32967 <br />ARTICLE 3 - ENGINEER <br />3.01 The Indian River County Public Works Department is hereinafter called the ENGINEER and <br />will act as OWNER's representative, assume all duties and responsibilities, and have the <br />rights and authority assigned to ENGINEER in the Contract Documents in connection with <br />the completion of the Work in accordance with the Contract Documents. <br />ARTICLE 4 - CONTRACT TIMES <br />4.01 Time of the Essence <br />Agreement - 00634 - 2 <br />F:\Purchasing\Bids\2021-2022 FY (2022000)\20220461R Boulevard Resurfacing IR-1707\Agreement.docx <br />
