Division 2 - Technical Provisions, IRC -1707 <br />H. In addition to above, the Contractor shall comply with INDIAN RIVER COUNTY TRAFFIC <br />ENGINEERING DIVISION SPECIAL CONDITIONS FOR RIGHT-OF-WAY CONSTRUCTION in <br />Appendix C. <br />Item of Payment <br />Payment for the work specified in this item shall be made under: <br />Bid Item No. 0102 1- Maintenance of Traffic — Per Lump Sum <br />SECTION 104 - PREVENTION, CONTROL, AND ABATEMENT OF EROSION AND WATER POLLUTION <br />PART 1— GENERAL <br />1.1 SCOPE <br />A. This Section covers erosion control and the treatment of dewatering water and stormwater <br />runoff from the construction site and work area. Pollution control measures shall prevent <br />polluted or turbid waters from being discharged from the construction site or work area to <br />undeveloped portions of the site or offsite, including but not limited to Multiple Separate <br />Storm Sewer Systems (MS4s) and Waters of the State. <br />B. The OWNER considers pollution from dewatering water and stormwater runoff from a <br />construction site or work area to be a very serious offense. The CONTRACTOR is solely <br />responsible for preventing pollution caused by dewatering water and stormwater runoff <br />from the construction site or work area. Note that state regulations do not allow mixing <br />stormwater and dewatering groundwater in the same release — separate and independent <br />discharges are required. <br />C. Pollution control measures specified herein represent minimum standards to be adhered to <br />by the CONTRACTOR throughout the Project's construction. The OWNER reserves the right <br />to require the CONTRACTOR to employ additional pollution control measures, when in the <br />sole opinion of the OWNER, they are warranted. If site specific conditions require additional <br />erosion and stormwater pollution control measures during any phase of construction or <br />operation to prevent erosion or to control sediment or other pollution, beyond those <br />specified in the Drawings, the Project's approved Stormwater Pollution Prevention Plan <br />(SWPPP), or herein, implement additional best management practices as necessary, in <br />accordance with Chapter 4, "Best Management Practices for Erosion and Sedimentation <br />Control" of the Florida Erosion and Sediment Control Inspector's Manual and other <br />references as may be applicable or required by regulatory permits. <br />D. The OWNER may terminate this Contract if the CONTRACTOR fails to comply with this <br />Section. Alternatively, the OWNER may halt the CONTRACTOR's operations until the <br />CONTRACTOR is in full compliance with this Section.
