construction or repair of a public building or public work, may not submit bids on leases of real property to <br />a public entity, may not be awarded or perform work as a contractor, supplier, subcontractor, or <br />consultant under a contract with a public entity, and may not transact business with any public entity in <br />excess of $25,000.00 for a period of thirty-six (36) months from the date of being placed on the convicted <br />vendor list or on the discriminatory vendor list. <br />(f) Any Recipient which is not a local government or state agency, and which receives funds <br />under this Agreement from the federal government, certifies, to the best of its knowledge and belief, that it <br />and its principals: <br />Are not presently debarred, suspended, proposed for <br />debarment, declared ineligible, or voluntarily excluded from covered transactions by a <br />federal department or agency; <br />Have not, within a five-year period preceding this proposal been <br />convicted of or had a civil judgment rendered against them for fraud or a criminal offense <br />in connection with obtaining, attempting to obtain, or performing a public (federal, state or <br />local) transaction or contract under public transaction; violation of federal or state antitrust <br />statutes or commission of embezzlement, theft, forgery, bribery, falsification or <br />destruction of records, making false statements, or receiving stolen property; <br />Are not presently indicted or otherwise criminally or civilly <br />charged by a governmental entity (federal, state, or local) with commission of any <br />offenses enumerated in Paragraph (18)(f)(ii) of this certification; and <br />iv. Have not within a five-year period preceding this Agreement had <br />one or more public transactions (federal, state, or local) terminated for cause or default. <br />(g) If the Recipient is unable to certify to any of the statements in this certification, then the <br />Recipient shall attach an explanation to this Agreement. <br />(h) In addition, the Recipient shall send to the Division (by email or by facsimile <br />transmission) the completed "Certification Regarding Debarment, Suspension, Ineligibility And Voluntary <br />Exclusion" (Attachment C) for each intended subcontractor which Recipient plans to fund under this <br />Agreement. The form must be received by the Division before the Recipient enters into a contract with <br />any subcontractor. <br />(i) The Division reserves the right to unilaterally cancel this Agreement if the Recipient <br />refuses to allow public access to all documents, papers, letters or other material subject to the provisions <br />of chapter 119, Florida Statutes, which the Recipient created or received under this Agreement. <br />(j) If the Recipient is allowed to temporarily invest any advances of funds under this <br />Agreement, any interest income shall either be returned to the Division or be applied against the <br />Division's obligation to pay the contract amount. <br />(k) The State of Florida will not intentionally award publicly -funded contracts to any <br />contractor who knowingly employs unauthorized alien workers, constituting a violation of the employment <br />14 <br />
