BOOK 97 u,E 102 <br />.Commissioner Tippin recalled that coffer dams were built <br />around trees in the center of the road on the Johns Island paving <br />project and the trees are still thriving. He felt that much of the <br />damage is caused by carelessness on. the part of the contractor and <br />it must be made emphatically clear that carelessness will not be <br />tolerated. <br />Richard Rhodes of 915 21st Avenue was concerned about drainage <br />backing up at his property, especially during rainy weather. He <br />also felt that he and his daughter-in-law who resides at the other <br />end of 21st Avenue are being penalized because they have acreage <br />rather than a lot. He inquired whether the assessments could be <br />figured some other way because his assessment is over $9,000. He <br />is now renting this property and does not have homestead exemption. <br />Director Davis explained that the existing drainage in the <br />area is not being modified but improved and should be better than <br />it is today. He also explained that staff had considered other <br />assessment options in allocating the costs, but felt this would be <br />the most equitable method. <br />Robert Oziemkowski of 956 21st Avenue felt that if the trees <br />can be saved, he would not be opposed to the project. He felt that <br />the 14 foot culverts planned for driveways would be excessive, and <br />Ms. Gentile explained that 14 feet must be used to allow for <br />widening of driveways. <br />Mr. Oziemkowski brought up a problem with an access from <br />Heritage Estates which allows drivers to cut across the front <br />corner of his neighbor's property. He wanted to know what could be <br />done to maintain this as a dead-end street as it was intended. <br />Director Davis responded that there is no right-of-way and the <br />drivers are trespassing. The property could be posted but this <br />project will not make it more accessible. <br />Tracey Monihan presented 2 letters from property owners in <br />favor of the project and requested that they be made part of the <br />record. <br />LETTERS ARE ON FILE IN THE OFFICE <br />OF THE CLERK TO THE BOARD <br />The Chairman asked if anyone else wished to be heard in this <br />matter. There being none, she closed the public hearing. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bird, the Board unanimously adopted <br />Resolution 96-04 confirming the assessment roll for <br />certain paving and drainage improvements to 9th <br />Place and 21st Avenue in Block Villa Subdivision. <br />JANUARY 16, 1996 12 <br />
