Community Development <br />12.A.1. 22-0782 Amendments to the Variance criteria and application fees <br />Recommended action: Staff recommends that the Board of County Commissioners review the proposed <br />changes to Land Development Regulations and provide direction to Staff. <br />Attachments: Staff Regort <br />Community Development Director Phil Matson stated that on August 16, 2022, <br />the Board directed staff to re-examine the County's Variance process. He stated <br />staff looked at application fees, de -minimus setbacks, and the variance criteria. <br />Director Matson proposed the following changes: 1) to reduce the application fee <br />from $1,000 to $500 for small-scale applications; 2) increase the de-minimis <br />setback variance to 1.0 feet from .5 feet; and 3) reduce the number of variance <br />criteria from 8 to 4. In addition to streamlining the variance process, staff was <br />considering several changes to the existing regulations for fences and accessory <br />structures which would make the variance process unnecessary. He stated staff <br />would return to the Board with a full recommendation. <br />Joseph Paladin of Black Swan Consulting spoke in support of the direction staff <br />was taking to revise the Variance process. <br />A motion was made by Commissioner Flescher, seconded by Commissioner <br />Adams, to approve staffs recommendation. The motion carried by the <br />following vote: <br />Aye: 5 - Chairman O'Bryan, Vice Chairman Earman, Commissioner Adams, <br />Commissioner Flescher, and Commissioner Moss <br />Meeting went into Recess at 11:08 a.m. and reconvened at 11:16 p.m. with all <br />Indian River County Florida Page 9 <br />
