Mehta, PE, Managing Director, Solid Waste Disposal District Subject: First Amendment and Renewal to the Biosolids Agreement between the Solid Waste Disposal District and the City of Vero Beach Descriptions and Conditions: On October 8, 2019, the City of Vero Beach (City) and the Indian River County (IRC) Solid Waste Disposal District (SWDD) entered into a Biosolids Disposal Agreement (Agreement) to accept the City's Dewatered Biosolids at the IRC Landfill for disposal. The initial term of this agreement is for a period of three (3) years terminating on October 7, 2022, and the City has duly notified SWDD of its desire to renew the Agreement. A draft First Amendment and Renewal to the Agreement was developed between the respective utility departments, at which time the updated Agreement was taken and approved by the Vero Beach City Council on September 6, 2022. Indian River County staff supports the approval of the attached agreement by the SWDD Board, Analysis: A brief summary of the attached First Amendment and Renewal of the Biosolids Agreement is as follows: • Term of the Agreement —The revised term of this agreement is effective as of the date that it is fully executed by both parties. The agreement shall automatically renew on October 1 of each year unless written notice of non -renewal or termination with appropriate notice as stipulated in the agreement. All other terms and conditions of the Agreement remain as is. In terms of the disposal rate, the City shall pay the 2022-2023 Fiscal Year (FY) Landfill Residue Disposal Fee of $24.23 per ton, reflecting an increase of $1.00, or 4.3%, from the 2021-2022 FY rate of $23.23 per ton. Currently, the IRC Landfill has been accepting the Biosolids from the City and averaging around 2,600 tons per year. At the new rate of $24.23 per ton, this equates to a revenue of $62,998 per year.
