Mehta, PE, Managing Director, Solid Waste Disposal District <br />Subject: First Amendment and Renewal to the Biosolids Agreement between the Solid Waste Disposal <br />District and the City of Vero Beach <br />Descriptions and Conditions: <br />On October 8, 2019, the City of Vero Beach (City) and the Indian River County (IRC) Solid Waste Disposal <br />District (SWDD) entered into a Biosolids Disposal Agreement (Agreement) to accept the City's <br />Dewatered Biosolids at the IRC Landfill for disposal. The initial term of this agreement is for a period of <br />three (3) years terminating on October 7, 2022, and the City has duly notified SWDD of its desire to <br />renew the Agreement. <br />A draft First Amendment and Renewal to the Agreement was developed between the respective utility <br />departments, at which time the updated Agreement was taken and approved by the Vero Beach City <br />Council on September 6, 2022. Indian River County staff supports the approval of the attached <br />agreement by the SWDD Board, <br />Analysis: <br />A brief summary of the attached First Amendment and Renewal of the Biosolids Agreement is as <br />follows: <br />• Term of the Agreement —The revised term of this agreement is effective as of the date that it is fully <br />executed by both parties. The agreement shall automatically renew on October 1 of each year unless <br />written notice of non -renewal or termination with appropriate notice as stipulated in the agreement. <br />All other terms and conditions of the Agreement remain as is. <br />In terms of the disposal rate, the City shall pay the 2022-2023 Fiscal Year (FY) Landfill Residue Disposal <br />Fee of $24.23 per ton, reflecting an increase of $1.00, or 4.3%, from the 2021-2022 FY rate of $23.23 per <br />ton. <br />Currently, the IRC Landfill has been accepting the Biosolids from the City and averaging around 2,600 <br />tons per year. At the new rate of $24.23 per ton, this equates to a revenue of $62,998 per year.
