Prado, Assistant County Attorney <br />DATE: September 27, 2022 <br />SUBJECT: Release of Right of Entry and Reservation of Mineral Rights <br />BACKGROUND: <br />As part of the sale of a strip of land from the County to Range Line Groves, Inc. on <br />December 5, 1989 the County pursuant to Florida Statute Section 270.11 retained the <br />right, reservation, title or interest to any phosphate, metal, mineral, and petroleum interest <br />on the property. This retention of rights is automatic upon the sale of the property. The <br />current owner of the property OCEAN SPRAY CRANBERRIES, INC. has contacted the <br />County and requested a release of the retained rights pursuant to Florida Statute Section <br />270.11. After inquiry with different departments, the County Attorney's Office has <br />determined that there is no need to withhold the release of these rights on this strip of <br />land. <br />FUNDING: <br />There is no cost associated with this item. <br />RECOMMENDATION: <br />The County Attorney's Office recommends that the Board approve the Release of Right <br />of Entry and Reservation of Mineral Rights and authorize the Chair to execute the Release <br />after final review and approval by the County Attorney. <br />Attachments: <br />Draft Release of Right of Entry and Reservation of Mineral Rights <br />Original County Deed Conveyance <br />
