Board of County Commissioners Meeting Minutes - Final October 4, 2022 <br />Ms. Corrente advised the Board that 67 certified letters were sent out to notify <br />property owners with past due accounts of potential foreclosure, giving the <br />owners 60 days to arrive at a settlement agreement noting there had been six <br />settlements to date. She stated that staff would work with either the County <br />Attorney's Office or outside counsel on the accounts with enforceable liens over <br />24 months to pursue foreclosure, noting there was still ample opportunities for <br />the individuals to settle on their past due accounts. The Board agreed it was not <br />the County's intention to foreclose on an individual's home, but to work with <br />the customer to settle. <br />Ms. Corrente provided a summary of bad debt for fiscal year ending September <br />30, 2022 in the amount of $632,604.80, action requested from staff, and <br />preventative measures going forward. Chairman O'Bryan and Vice Chairman <br />Earman sought and received information from Ms. Corrente on the reason why <br />the foreclosure notices for the water and sewer accounts were not 12 months <br />instead of 24 months in arrears and not 24 months instead of 48 months in <br />arrears for loan or assessment accounts. <br />A motion was made by Commissioner Flescher, seconded by Commissioner <br />Adams, to approve staffs recommendation. The motion carried by the following <br />vote: <br />Aye: 5- Chairman O'Bryan, Vice Chairman Earman, Commissioner Adams, Commissioner <br />Flescher, and Commissioner Moss <br />The Chairman called a recess at 10:29 a.m., and reconvened the meeting at 10:40 <br />a.m., with all members present. <br />13. COUNTY ATTORNEY MATTERS <br />13.A. 22-0808 Website Publication of Legal Notices <br />Recommended action: The County Attorney's Office recommends that the Indian River County Board of <br />County Commissioners provide direction on the use of the County website for <br />publication of notices for the County and other jurisdictions. <br />Attachments: Staff Report <br />County Attorney Dylan Reingold referred to his memorandum dated September 16, <br />2022, stating the Florida Legislature enacted House Bill 7049 in regard to the <br />posting of notices for public hearings, the changes made to the legal notices and <br />official advertisements provisions of the Florida Statutes that would go into effect <br />on January 1, 2023. He outlined the key points of the new statutory requirements <br />that impact Indian River County, stating certain notices previous required to be <br />Indian River County Florida Page 9 <br />
