1. Amendments which change the actual list of permitted, <br />conditional, or prohibited uses within a zoning category <br />(district); and <br />2. All other types of amendments. <br />One of the proposed amendments would change the zoning districts in <br />which cemeteries are allowed as a special exception (conditional) <br />use. Therefore, that amendment requires two hearings. The new <br />legislation provides that one of those two hearings can be held <br />after 5:00 p.m. but that both hearings could be held before 5:00 <br />p.m. (e.g. regular Board meeting times) by a majority plus 1 vote <br />of the Board. Thus, with 4 or 5 positive votes the Board could <br />vote to hold both LDR hearings before 5:00 p.m., such as at a <br />regular Tuesday morning Board meeting. All of the other amendments <br />are required by the new legislation to be considered at only one <br />hearing, which could be held before 5:00 p.m. <br />Two hearings will be required to be held in regard to the cemetery <br />use proposal. In addition, staff notes that one of the other LDR <br />amendments, which relates to commercial vehicles in residential <br />areas, has been controversial and has involved significant <br />discussion. To accommodate the legal requirements- of_the cemetery <br />use proposal and to facilitate discussion of the coipmerdia *vehicle <br />proposal, it is staff's opinion that all of the LDR amendments <br />should be considered at two hearings. It is also staff's opinion <br />that the first hearing should be held after 5:00 p.m. to <br />accommodate possibly lengthy discussion and input from members of <br />the public for whom the 5:01 meeting time is more convenient. The <br />second hearing, which is generally shorter and more of a "wrap-up" <br />meeting, could be held during a regular Tuesday morning Board <br />meeting. <br />One set of hearing dates which would comply with state hearing and <br />advertizing requirements, would allow for two hearings for all <br />proposed amendments, and appears to accommodate Commissioners <br />schedules, is as follows: <br />Hearing Date Time <br />1. Special meeting Tuesday, February 13, 1996 5:01 P.M. <br />2. Regular meeting Tuesday, February 27, 1996 9:05 a.m. <br />Staff has tentatively reserved use of the Commission Chambers for <br />these proposed dates. The Board may establish any other dates that <br />meet state requirements and during which the Chambers may be used. <br />RECOMMENDATI-ON: <br />Staff recommends that the Board establish meeting dates for two <br />public hearings to consider and adopt the proposed LDR amendments. <br />ON MOTION by Commissioner Macht, SECONDED by <br />Commissioner Eggert, the Board unanimously approved <br />public hearing dates of February 13, 1996, at 5:01 <br />p.m. and February 27, 1996, at 9:05 a.m., as <br />recommended by staff. <br />27 <br />January 23, 1996 <br />BOOK 97 r,ArA44 <br />
