ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Macht, the Board unanimously awarded <br />the contract to Cathco, Inc., -in the amount of <br />$51,550.00; deleted the performance and payment <br />bonds requirement; and directed that all insurance <br />certificates. and other formalities and bid documents <br />be submitted and approved by appropriate staff, <br />including the County Attorney's office, prior to <br />issuance of a Notice to Proceed by the Department of <br />Public Works (Alternative No. 1), as recommended in <br />the Memorandum. <br />AGREEMENT ON FILE <br />IN THE OFFICE OF THE CLERK TO THE BOARD <br />26TH STREET RIGHT-OF-WAY ACQUISITION - PARCEL #103 <br />SYLVIA GREEN <br />The Board reviewed a Memorandum of January 11, 1996: <br />TO: James E. Chandler <br />County Administrator <br />THROUGH: James W. Davis, P.E. <br />Public Works Directo <br />AND <br />Roger D. Cain, P.E <br />County Engineer <br />FROM: Donald G. Finney, S=�ar <br />County Right -of -Way Agent <br />SUBJECT: 26th Street Right -of -Way Acquisition; Parcel #103 <br />DATE: January 11, 1996 <br />DESCRIPTION AND CONDITIONS <br />Thirty to sixty feet of additional right-of-way is required for the <br />paving improvement project between 58th Avenue and 66th Avenue on <br />the north side of 26th Street. <br />Consideration for the donated right-of-way will be no assessment <br />for paving, construction, utilities, drainage or any other expenses <br />associated with 26th Street improvements. The property owners has <br />added a condition to the contract, that a six foot high berm be <br />� a <br />constructed along the front oftowner Is property. The DeBartolo <br />Corp. has indicated that they will"provide the fill and construct <br />the berm on the owners property: . "' <br />RECOMMENDATION <br />Staff requests the Board of 'County commissioners approve the <br />contract and authorize the Chairmap to execute the contract, <br />subject to the contract condition that the berm be built by and <br />materials and labor be furnished and paid for by DeBartolo Corp. <br />FUNDING <br />Funding to be from Account No. 315-214-541-066.12. . <br />MV <br />January 23, 1996 <br />BOOK 97 F,F 156 <br />
