40 <br />PETITION <br />r^l <br />4 The Board of County Commissioners <br />of Indian River County, Florida <br />Vero Beach, Florida <br />Gentlemen: <br />The undersigned Petitioner, GENERAL DEVELOPMENT CORPORATION, <br />a Delaware corporation, authorized to do business in the State of <br />Florida, does herewith petition you to adopt a resolution closing, <br />vacating and abolishing the public roads and right of way located <br />on the plat of VERO BEACH HIGHLANDS UNIT ONE, as recorded in Plat <br />Book 5, Page 29, of the Public Records of Indian River County, as <br />it pertains to the following described property situated in Indian <br />River County, Florida: <br />The South 35 feet of the Northeast 1/4 <br />of Section 31, Township 33 South, Range <br />40 East, lying westerly of the West Right <br />of Way of U. S. Highway No. 1 and Easterly <br />of the East Right of Way of Old Dixie <br />Highway which was platted as 21st Street, <br />S. W. on Vero Beach Highlands Unit One, <br />and dedicated to the Public on said plat. <br />Said plat is recorded in Plat Book 5, <br />Page 29, of the Public Records of Indian <br />River County, Florida. <br />and requests said Board to renounce and disclaim any right of the <br />said County and the public in and to the above described public <br />road and right of way as delineated on said recorded plat. <br />The Petitioner, GENERAL DEVELOPMENT CORPORATION, a Dela- <br />ware corporation, is the owner of the property adjoining the above <br />property sought to be abandoned and the said property sought to be <br />, abandoned is not a State or Federal Highway. <br />reasons: <br />The Petitioner requests this abandonment for the following <br />1. Subject street has been dedicated but never constructed. <br />2.
