RESOLUTION NO. 7;-2 <br />WHEREAS, the Zoning Commission of Indian River County, Flor- <br />9 <br />® ida, did, after public hearing, make its final report recommend- <br />ing changes and additions to the Zoning Ordinance of Indian River <br />® = County, Florida; and, <br />WHEREAS, this Board did publish its notice of said recommended <br />changes and additions and did, pursuant thereto, hold a public hear- <br />ing in relation thereto at which parties in interest and citizens <br />were heard: Now, therefore, <br />BE IT RESOLVED by the Board of County Commissioners of Indian <br />River County, Florida, that the Zoning Ordinance of Indian River <br />County, Florida, and the accompanying Zoning Map, be changed as <br />follows: <br />1. That the Zoning Map be changed in order that the follow- <br />ing property owned by Henry Fischer, et al, John L. Ashby, Co -Owner, <br />situated in Indian River County, Florida, to -wit: <br />The NE 1/4 of SW 1/4; SW 1/4 of SW 1/4; and SE 1/4 of SW 1/4, <br />less one acre to the Board of Public Instruction; all in Sec- <br />tion 14, Township 31 -South, Range 38 -East; AND <br />SE 1/4 of NW 1/4; S 1/2 of NE 1/4 of NW 1/4; NW 1/4 of NE 1/4 <br />of NW 1/4; AND all of the NE 1/4 of SW 1/4 except that part <br />lying West of the'river and South of ,he County road, and <br />except that part of the S 1/2 of the NE 1/4 of the SW 1/4 <br />lying Fast of the river; all in Section 23, Township 31 - <br />South, Range 38 -East; also except rights-of-way of Fellsmere <br />Railroad and State Highway No. 512; <br />All of said land lying and being in Indian River County, Flor- <br />ida. <br />LESS AND EXCEPTING that certain property owned by Stanley W. <br />Smith and Worth Smith, as shown in that certain Final Decree, <br />recorded in Official Record Book 259, page 453, public re- <br />cords of Indian River County, Florida, described as follows: <br />That part of the S 1/2 of the NE 1/4 of the SW 1/4, Section <br />23, Township 31 -South, Range 38 -East, lying East of the <br />Sebastian River, all of the same lying and being in Indian <br />River County, Florida; AND ALSO <br />That part of the NE 1/4 of the SW 1/4, Section 23, Township <br />31 -South, Range 38 -East, lying East of the Sebastian River, <br />except that part lying North of State Road No. 512, in Indian <br />River County, Florida. <br />Be changed from A -Agricultural District, to R-lE Country <br />Estate District. <br />All within the meaning and intent and as set forth and describ- <br />ed in said Zoning Regulation. <br />-31- <br />
