Require <br />citrus_ <br />of host <br />the Trails End developer to grant <br />owners an easement that prohibits the <br />plants on the Trails End site.' <br />to nearby <br />occurrence <br />After reviewing the issue further, planning staff has <br />concluded that an easement requirement would be a significant <br />departure from its current regulations and policies which <br />require compensation for easements. Also, it is planning <br />staff's opinion that the first two options presented above <br />would be effective in preventing host plants on the Trails End <br />site. In recent discussions with staff, the applicant has <br />indicated that he would not object to a condition establishing <br />a host plant prohibition and requiring a deed restriction <br />prohibition. In planning staff's opinion, such a condition <br />incorporating these two options would adequately and equitably <br />address the host plant issue. <br />16. Waivers: The applicant is not requesting any waivers through <br />the PD process, and none will be granted if this request is <br />approved. <br />17. Surrounding Land Use and Zoning: <br />North: 21st Street S.W., Citrus Groves/A-1 <br />South: Citrus Groves/A-1 <br />East: Citrus Groves/A-1 <br />West: 58th Avenue S.W., Citrus Groves/A-1 <br />RECOMMENDATION: <br />Based on the above analysis, staff recommends that the Board of <br />County Commissioners grant PD -special exception use approval with <br />the following conditions: <br />1. That prior to issuance of a land development permit, the <br />applicant shall obtain an Indian River County Wetland Resource <br />permit. <br />2. That prior to or via the final plat approval, the applicant <br />shall dedicate without compensation right-of-way for 21st <br />Street S.W. sufficient to complete the local road right-of-way <br />width of 601. <br />3. That the minimum building setback from the east and south <br />property lines be 50' from the perimeter property line. <br />4. That a 6' high opaque double frontage buffer be preserved <br />along the project east property line where the road is <br />adjacent to the property line, or that such a buffer be <br />installed prior to issuance of a certificate of completion if <br />existing vegetation along the east property line is removed. <br />5. That, as referenced in attachment #6 of this report, Caribbean <br />Fruit Fly host plants shall be prohibited within the Trails <br />End Subdivision%with said prohibition enforceable through the <br />county code enforcement board.
