O'Brien - Assistant County Attornefp <br />DATE: January 31, 1996 <br />SUBJECT: PUBLIC HEARING - FEBRUARY S. 1996 <br />PROPOSED ORDINANCE AMENDING REGULATIONS <br />GOVERNING WHEELCHAIR SERVICES <br />On January 16, 1996 the Board of County Commissioners authorized <br />advertisement of the attached ordinance. The ordinance provides for <br />regulations on non -emergency wheelchair transport services. <br />Recommendation: <br />Staff recommends approval of the ordinance. <br />Assistant County Attorney Terry O'Brien advised that the <br />proposed ordinance is a modification of Ordinance 95-22 that the <br />Board adopted last September. This modification will require non- <br />emergency wheelchair transport services to have a certificate of <br />need. This takes into consideration the wheelchair services where <br />no certificate of need and no government funds are required and it <br />is strictly a private operation. <br />Commissioner Eggert explained that when we were looking at <br />wheelchair services before adopting the initial ordinance, we found <br />that a number of groups had "in-house service." For example, the <br />in-house service was going out to pick up people for out-patient <br />therapy and then taking them home again. In talking to a number of <br />them, they had no real objection to obtaining an E1 for a very <br />minor payment like $25 or under and one which would be renewed <br />automatically. We, in turn, would get information we need both for <br />transportation disadvantaged and the MPO, in addition to knowing <br />that vehicles were indeed carrying our residents around and were <br />safe. She appreciated the Board's consideration of this <br />modification. <br />Chairman Adams opened the Public Hearing and asked if anyone <br />wished to be heard in this matter.
