RESOLUTION NO. 76-28 <br />WHEREAS, there is now pending before the regular 1976 session <br />of the Florida Legislature Senate Bill 83 providing for imprisonment <br />in the County Jail if the total accumulative sentences of the prisoner <br />do not exceed five (5) years; and <br />WHEREAS, there is now pending before said session of the Florida <br />Legislature Senate Bill No. 143 providing in part that the Boards <br />of County Commissioners are required to pay to the Florida Department <br />of Offender Rehabilitation for Work -Release Programs for prisoners <br />out of County Fine and Forfeiture Funds; and <br />WHEREAS, it appears that the enactment of said Bills, or either <br />of them, could create a substantial financial hardship upon the <br />County of Indian River and the taxpayers of Indian River County; and <br />WHEREAS, Section 922.051 of the Florida Statutes as it presently <br />exists authorizes the Court to impose a sentence of imprisonment <br />in the County Jail of the total of the accumulative sentences is <br />not more than one (1) year and the enactment of Senate Bill No. 83 <br />will substantially increase the financial responsibility of the <br />several Counties in the operation and maintenance of County Jails; <br />and <br />WHEREAS, the Work -Release Programs for prisoners at the present <br />time are funded by the State of Florida and operated by the Florida <br />Department of Offender Rehabilitation and such a program is in <br />existence in Indian River County with permanent improvements and <br />other facilities for said program being constructed or obtained <br />through funds of the State of Florida, and said Senate Bill 143 could <br />require Indian River County to assume the cost of constructing, <br />obtaining or operating the facilities for the Work -Release Program <br />in Indian River County out of the Fine and Forefeiture Funds of <br />Indian River County to the financial detriment of Indian River <br />County; and <br />WHEREAS, it is expedient and to the best interests of Indian <br />River County and to the taxpayers of Indian River County to express <br />opposition to the enactment of said pending legislation. <br />
