40 <br />• <br />I <br />JUN 81977 <br />RESOLUTION NO. 79-32 <br />WHEREAS, this Board heretofore did grant a water and sewer franchise <br />to Southern Gulf Utilities, Inc.. said franchise being known as the Southern Gulf <br />Utilities Water and Sewer Franchise, and <br />WHEREAS, said franchise was subsequently amended by Resolution Nos. <br />67-20 and 73-44, and <br />WHEREAS, pursuant to Section XIII of said franchise, a request was <br />received for transfer and assignment of said franchise to Treasure Coast Utilities, <br />Inc., and <br />WHEREAS, publication of a Notice of Public Hearing was duly mide, and <br />WHEREAS, this Board did .on March 24, 1976 hold a public hearing, said <br />public hearing being continued from time to time thereafter. <br />NOW, THEREFORE, BE 1T RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that the water and sewer <br />franchise previously issued to Southern Gulf Utilities, Inc. is hereby transferred <br />to Treasure Coast Utilities, Inc. and shall henceforth be known as the "Treasure <br />Coast Utilities, Inc. Water and Sewer Franchise". <br />BE IT FURTHER RESOLVED THAT Section XXI of the Franchise be amended <br />so as to add the following provision. <br />The franchise and rights granted herein shall be terminated earlier in <br />the event the County, or a municipal corporation of the State of Florida, within the <br />territory of this franchise, installs or acquires its own sewerage and/or water <br />collection and treatment system and supplies the same to Individual customers at <br />which time, the company will convey. all of its mains, lines and easements which <br />company may own, free and clear of all liens and mortgages to said county or <br />municipal corporation without charge. <br />BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA <br />By /] <br />Attest: <br />ACCEPTANCE <br />The undersigned hereby accepts the foregoing Resolution and the <br />Franchise as amended, transferred by this Resolution and for themselves, their <br />successors and assigns, do hereby covenant and agree to comply with and abide by <br />all of the terms, conditions and provisions set forth in said Franchise as amended. <br />DATED this qday of 1974. <br />TREASURE CO ' UTILITIES IN . <br />B <br />res e <br />a <br />196 <br />
