n <br />u <br />RESOLUTION NO. 76-50 <br />WHEREAS, the Trustees of the Internal Improvement Fund <br />• by Dedication dated March 9, 1967 and numbered 24499, dedicated <br />property in Indian River County, Florida, for public park and <br />recreation purposes, which park is now known as Kiwanis-Hobart <br />Park; a copy of said Dedication is attached and incorporated <br />into this Resolution; and <br />WHEREAS, the F A A has required Indian River County to <br />close the present County landfill area located on and adjacent <br />to the Vero Beach Airport; and <br />WHEREAS, an emergency now exists to establish a new <br />County landfill and Indian River County owns no suitable land <br />for a landfill; and <br />WHEREAS, because of the emergency, Indian River County <br />requests the use of a portion of the dedicated property described <br />as: <br />A portion of the Southeast quarter less Southeast <br />quarter of Southeast quarter of Southeast quarter <br />and less East 40 feet for road right-of-way of <br />Section 32, Township 31 South, Range 39 East - <br />for landfill purposes; and <br />WHEREAS, any use of the dedicated property for landfill <br />purposes will be engineered, constructed and designed in accord <br />with the future long-range needs of Kiwanis-Hobart Park; and <br />WHEREAS, the described property is in fact the last <br />designated area in the development plan for the Kiwanis-Hobart <br />Park; and <br />WHEREAS, the use of the described property for land- <br />fill purposes will be subject to the approval of the Department <br />of Environmental Regulations and of other appropriate Regulating <br />Agencies; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that the <br />Dedication from the Trustees of the Internal Improvement Fund <br />referenced above is requested to be expanded allowing an <br />interim use of the above described property for landfill <br />
